1. Agreement to Terms

By downloading, installing, or using TranslateIt (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and iPhone Tools ("we", "us", or "our").

2. Description of Service

TranslateIt is an iOS application that provides voice, photo, and text translation across 20+ languages, with both cloud-based and on-device (offline) translation modes. The App allows users to:

  • Record speech and receive instant transcription and translation
  • Photograph menus, signs, or documents and translate the extracted text
  • Type or paste text for translation
  • Use offline mode for on-device translation without an internet connection
  • Share text or images from other apps directly into TranslateIt
  • Browse a searchable history of past translation sessions
  • Optionally serve as the system Default Translation App on iOS 18.4+

3. Account Registration

You may use the App as a guest without creating an account. To sync history across devices you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. License and Restrictions

4.1 License Grant

Subject to these Terms and applicable App Store terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for your personal, non-commercial use.

This App is intended for personal use only and is not licensed for commercial use. You may not use the App or its translation output as part of any commercial product, service, or business operation without prior written permission from iPhone Tools.

4.2 Restrictions

You agree NOT to:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Remove any copyright, trademark, or other proprietary notices
  • Use the App for any illegal or unauthorized purpose
  • Submit content that infringes the rights of others, is harassing, or is unlawful
  • Attempt to circumvent the trial period or subscription system
  • Use automated tools to access or interact with the App
  • Resell, sublicense, or distribute the App or its output to third parties

5. Subscription Terms

5.1 Free Trial

New users receive a 7-day free trial of all cloud features. No account or payment information is required to start the trial. After the trial period ends, cloud features (cloud-based audio translation, document OCR translation, and history sync) require an active subscription.

5.2 Offline Mode — Free Forever

Offline (local) mode is always free and unlimited. It does not require a subscription or an account, and it does not count toward any quota. Offline translation runs entirely on your device using Apple's frameworks.

5.3 Paid Subscriptions

A subscription unlocks ongoing access to cloud features after the trial ends:

  • Monthly Subscription: Billed monthly
  • Yearly Subscription: Billed annually (best value)

5.4 Payment and Billing

All purchases are processed through Apple's App Store:

  • Payment is charged to your iTunes Account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your App Store Account Settings

5.5 Cancellation

You may cancel your subscription at any time through your App Store Account Settings. Cancellation takes effect at the end of the current billing period. Cloud-feature access continues until the end of the paid period. Offline mode continues to work indefinitely.

6. Translation Disclaimer

Translations and transcriptions produced by the App are provided for informational purposes only. You acknowledge that:

  • Translations may be inaccurate, incomplete, or contextually wrong
  • Results must not be relied upon for medical, safety, legal, contractual, or critical decisions
  • Speech recognition accuracy depends on audio quality, accents, and background noise
  • OCR accuracy depends on lighting, focus, font style, and language
  • Offline translation models are smaller than cloud models; quality may differ between modes

Always consult a qualified human translator or professional for decisions that matter.

7. Acceptable Use

You agree to use the App only for lawful purposes. You must not use the App to:

  • Process content that is illegal, abusive, harassing, or hateful
  • Record people without their consent in jurisdictions where that is unlawful
  • Infringe on the intellectual property rights of others
  • Engage in any activity that could harm minors
  • Attempt to harm, disrupt, or gain unauthorized access to our servers or systems

We reserve the right to terminate accounts that violate these guidelines.

8. Disclaimers and Limitations of Liability

8.1 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Translation or transcription results will be accurate or complete
  • The App will be compatible with all devices or iOS versions
  • The App is free of viruses or harmful components

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IPHONE TOOLS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR RELIANCE ON ITS TRANSLATIONS.

Our total liability to you for all claims related to the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Data and Privacy

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle data.

10. Intellectual Property

The App, including all content, features, functionality, source code, and user interface, is owned by iPhone Tools and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

TranslateIt, iPhone Tools, and associated logos are trademarks of iPhone Tools. You may not use these marks without our prior written permission.

11. Third-Party Frameworks

Offline (local) translation in the App uses Apple's Translation and Speech frameworks. Use of these features is also subject to Apple's terms governing those frameworks. Language pack downloads are managed by iOS system-wide.

12. Apple App Store Terms

These Terms are between you and iPhone Tools, not Apple. Apple has no obligation to provide maintenance or support for the App. You agree that:

  • Apple is not responsible for the App or its content
  • Apple has no warranty obligations regarding the App
  • Apple is not responsible for addressing claims related to the App
  • Apple is a third-party beneficiary of these Terms and may enforce them

Your use of the App must comply with Apple's App Store Terms of Service.

13. Updates and Changes

13.1 App Updates

We may release updates, new features, or bug fixes at any time. Updates may change translation behavior, supported languages, or available features. You are responsible for maintaining compatible iOS versions.

13.2 Terms Changes

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Termination

14.1 Termination by You

You may terminate these Terms at any time by:

  • Deleting your account within the App
  • Canceling your subscription through the App Store
  • Deleting the App from your device

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in fraudulent, illegal, or abusive conduct.

14.3 Effect of Termination

Upon termination:

  • Your license to use the App terminates immediately
  • Your account and associated data will be deleted
  • No refunds will be provided for remaining subscription periods

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction where iPhone Tools operates, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or the App shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in courts of competent jurisdiction.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
